JAPAN ART FAIR GENERAL TERMS & CONDITIONS FOR VISITORS

Japan Art Fair  (JAF)
As applicable per 01-01-2025

JAF will take every measure possible to ensure a safe environment during the Fair. To this effect, JAF will continue to adhere to health and safety regulations at all times.

Visitors must note that participation in the Fair is subject to these Conditions for Visitors and the house rules of the event venues used by JAF. Visitors are required by law to adhere to instructions given by local authorities.

ARTICLE 1 – DEFINITIONS

  • Article: A section of the Conditions for Visitors.
  • Conditions for Visitors: These JAF General Terms & Conditions for Visitors.
  • Executive Committee: The executive committee of Japan Art Fair.
  • Fair: A fair organized by JAF in the respective Hall. References to “the Fair” refer to any applicable JAF event.
  • Hall: The premises where the Fair takes place: Geertebolwerk 1, 3511XL Utrecht, The Netherlands.
  • Management: The General Director of JAF and its staff.
  • Participant: An art gallery or other entity renting a stand from JAF at the Fair.
  • JAF: Japan Art Fair Foundation, with a registered seat in Utrecht, The Netherlands.
  • JAF Information Media: Any media by which JAF publicly distributes information about the Fair, including online catalogs, mobile applications, JAF website, printed materials, and social media.
  • Vetting Committee: The committee that evaluates and approves artworks for exhibition at the Fair, composed of independent art specialists selected based on expertise, integrity, and independence.
  • Visitor: Any individual or legal entity visiting the Fair unless acting as a Participant or contractor of JAF.

 

ARTICLE 2 – ROLE OF JAF

Japan Art Fair organizes the Fair to serve as a platform connecting Visitors and Participants, creating an optimal environment for viewing, exhibiting, and purchasing artworks.

JAF does not own any artworks exhibited by Participants and does not act as a seller or buyer. JAF is not involved in any transactions of artworks during the Fair, nor does it provide transport services for purchased artworks.

While JAF, through the Vetting Committee, ensures high standards for the selection of exhibited works, the responsibility for displaying, selling, and purchasing artworks remains solely with the Participants and Visitors. Visitors are encouraged to conduct due diligence before making purchases and seek independent professional advice as needed.

JAF merely provides the platform to connect Participants and Visitors and is not responsible for communications or transactions between them.

 

ARTICLE 3 – ACCEPTANCE OF THE REGULATIONS

By purchasing a ticket or accepting an invitation and attending the Fair, the Visitor agrees to these JAF General Terms & Conditions.

 

ARTICLE 4 – SALE OF TICKETS

JAF is not liable for errors made by third parties in ticketing information or event details. JAF does not permit resale of entrance tickets except through JAF or its designated partners. All tickets are non-refundable and personal. Visitors may be required to show valid proof of identity upon entry.

 

ARTICLE 5 – CANCELLATION, TERMINATION, POSTPONEMENT, OR ADAPTATION OF THE FAIR

JAF reserves the right to cancel, postpone, or modify the Fair as necessary due to unforeseen circumstances such as natural disasters, political unrest, or government directives. If the Fair is canceled or postponed, Visitors shall have no claim against JAF except for a ticket refund where applicable.

 

ARTICLE 6 – DURING THE VISIT TO THE FAIR

Visitors must comply with JAF’s rules and security measures. Any Visitor acting in violation of these terms, local regulations, or JAF’s house rules may be removed from the Fair without a refund and denied future access.

Visitors are prohibited from:

  • Taking photo’s and/or video’s inside the Fair without consent of the Participant.
  • Selling or distributing goods inside the Fair without authorization.
  • Bringing unauthorized objects such as large bags, professional recording equipment, or dangerous items.
  • Organizing unauthorized guided tours or promotional activities.
  • Engaging in behavior that disrupts the Fair’s orderly conduct.
  • JAF or third parties may make video, photographic, and/or audio recordings of the Fair for documentation and promotional purposes. By attending, Visitors consent to being recorded and grant JAF the right to use such recordings for related promotional activities.

 

ARTICLE 7 – SAFETY AND SECURITY REGULATIONS

JAF implements safety measures at the Fair, including bag checks and identity verification. Visitors refusing to comply with security procedures may be denied entry. Any activity that disrupts the Fair’s peaceful environment, including protests or unauthorized gatherings, is strictly prohibited.

 

ARTICLE 8 – JAF INFORMATION MEDIA

Information in JAF Information Media, including details on artworks, authenticity, and provenance, is provided by Participants and is their sole responsibility. JAF does not guarantee the accuracy of such information and advises Visitors to seek independent professional advice before making a purchase.

 

ARTICLE 9 – COMPLAINTS AND CLAIMS

Claims from Visitors must be submitted in writing to JAF Management within four (4) weeks of the event in question. JAF is not responsible for complaints related to third parties and will provide relevant contact details when necessary.

 

ARTICLE 10 – LIABILITY OF JAF

JAF, its employees, and representatives, including the Vetting Committee, shall not be liable for any losses or damages related to the exhibition, sale, or purchase of artworks at the Fair. Responsibility remains solely with the Participants and Visitors involved in transactions.

JAF is not liable for damages caused by force majeure, third parties, or cybersecurity breaches. In any event, JAF’s liability is limited to the extent covered by its insurance policy.

 

ARTICLE 11 – APPLICABLE LAW AND JURISDICTION

The relationship between Visitors and JAF is governed by the laws of The Netherlands. Any disputes shall first be attempted to be resolved through mediation. If mediation fails, disputes will be settled exclusively by the competent courts in Utrecht, The Netherlands.

 

ARTICLE 12 – MISCELLANEOUS

Any issues not expressly covered in these Terms & Conditions shall be decided by JAF in accordance with applicable law. If any provision is found invalid, the remaining provisions shall remain in effect.

JAPAN ART FAIR ONLINE TERMS & CONDITIONS FOR VISITORS

The Japan Art Fair As applicable per 01-01-2025

ARTICLE 1 – DEFINITIONS

In these Japan Art Fair (JAF) Online Terms & Conditions for Visitors, the following terms are defined as set forth below:

Article: an article of the Japan Art Fair Online Terms & Conditions for Visitors. JAF Online Terms & Conditions for Visitors: these Japan Art Fair Online Terms & Conditions for Visitors. Management: The General Director of JAF and his/her staff. Participant: an art business or other entity participating in the Japan Art Fair Online by exhibiting artworks through JAF’s digital platform. Registered Visitor: A Visitor who has registered for JAF Online by providing required information through the designated part of the JAF website and accesses the digital platform via login. JAF: Japan Art Fair, located at Geertebolwerk 1, 3511XL Utrecht, The Netherlands. JAF Online: an online sales and exhibition platform hosted by JAF, providing access to digital exhibitor pages where visitors can explore artworks and interact with Participants. JAF Information Media: any media by which JAF publicly distributes information regarding JAF Online, including the online catalogue, JAF website, printed material, and social media. Visitor: a natural person or legal entity visiting the JAF Online platform either as a Registered or non-registered Visitor, unless such person or entity is attending as a Participant or contractor of JAF and only while acting in that capacity.

ARTICLE 2 – ROLE OF JAPAN ART FAIR ONLINE

JAF Online connects Visitors with Participants in a digital environment, facilitating the exhibition and potential sale of artworks. JAF does not own or take responsibility for any artworks displayed through JAF Online, nor does it act as an intermediary in transactions. All sales agreements and related responsibilities lie solely with the Participants and Visitors. JAF does not provide transportation or payment services for artworks purchased through JAF Online.

ARTICLE 3 – ACCEPTANCE OF THE REGULATIONS

The JAF Online Terms & Conditions for Visitors apply to all legal relationships between JAF and Visitors. By accessing JAF Online and/or registering as a Registered Visitor, the Visitor agrees to these Terms & Conditions.

ARTICLE 4 – CANCELLATION, TERMINATION, POSTPONEMENT OR ADAPTATION OF JAPAN ART FAIR ONLINE

JAF may cancel, postpone, or adapt the operation of JAF Online if deemed necessary. Such actions may be taken due to force majeure (including but not limited to war, political unrest, strike, flood, public health crises, fire, robbery, or financial crisis) or any other event beyond JAF’s control that prevents JAF Online from functioning as intended. JAF shall not be liable for any loss or damages incurred by Visitors due to such changes.

ARTICLE 5 – USE OF JAPAN ART FAIR ONLINE

Visitors who act in violation of applicable laws, regulations, or these Terms & Conditions, or who disrupt JAF Online, may be removed from the platform and denied future access. JAF reserves the right to take necessary measures to protect its reputation and the experience of all Participants and Visitors.

Visitors are not permitted to:

  • Offer goods for sale outside the designated exhibitor pages.

  • Make professional recordings or photographs of the JAF Online platform for commercial purposes without prior approval from JAF.

  • Engage in unauthorized promotional activities or misrepresent their role at JAF Online.

JAF does not guarantee that JAF Online is secure or free from technical issues. Visitors are responsible for using appropriate cybersecurity measures when accessing the platform.

ARTICLE 6 – JAF INFORMATION MEDIA

Information provided in JAF Information Media, including the JAF Online platform, is the responsibility of the relevant Participant. JAF does not guarantee the accuracy of descriptions, provenance, or pricing of artworks displayed online. Visitors should seek independent professional advice before making a purchase.

ARTICLE 7 – COMPLAINTS AND CLAIMS

Any claim by a Visitor must be submitted in writing to JAF Management within four (4) weeks of the event giving rise to the claim. JAF is not liable for disputes between Visitors and Participants. Complaints regarding third parties should be addressed directly to the parties involved. JAF will provide relevant contact details upon request.

ARTICLE 8 – LIABILITY OF JAPAN ART FAIR

JAF, its employees, and representatives shall not be liable for any claims, losses, or damages related to the description, authenticity, provenance, or condition of artworks exhibited at JAF Online. Visitors access JAF Online at their own risk. JAF is not responsible for technical failures, cyberattacks, or losses resulting from force majeure or third-party actions.

ARTICLE 9 – APPLICABLE LAW AND JURISDICTION

The relationship between the Visitor and JAF and all disputes arising therefrom are governed by the laws of The Netherlands. Parties will attempt to resolve disputes through mediation under the rules of the Dutch Mediation Federation. If mediation is unsuccessful, disputes shall be settled by the competent court in Utrecht, The Netherlands.

ARTICLE 10 – MISCELLANEOUS

All issues not expressly covered in these Terms & Conditions shall be decided solely by JAF, subject to applicable law. The invalidity of any provision does not affect the validity of the remaining provisions. The section headings are for reference only and do not influence interpretation.

These terms and conditions apply to your use of the website www.japanartfair.com. By using the website, you accept these terms and conditions in full. If you disagree with these terms and conditions, you must not use this website.

These terms and conditions are governed by the laws of The Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of Utrecht.
